PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING ANY PART OF THE SERVICE.
1. OVERVIEW BeyondEdge Inc., a Delaware corporation ("BeyondEdge,” “we,” “our,” or “us”) owns and operates the website https://www.beyondedge.school/ together with the related mobile, desktop and connected‑platform applications, communication channels, and online community spaces (collectively, the “Service”). The Service delivers online education, training, and community engagement focused on artificial‑intelligence‑powered filmmaking, video production, and digital‑content creation (the “School”). By creating an account, purchasing a product, or otherwise using the Service you ("you" or "User") agree to be bound by (i) these Terms of Use (the “Terms”), (ii) our Privacy Policy, and (iii) any supplemental terms referenced in a specific offering (collectively, the “Agreement”). IF YOU DO NOT ACCEPT THE AGREEMENT, DO NOT ACCESS OR USE THE SERVICE.
2. DEFINITIONS • “Course Materials” – video lessons, live classes, assignments, templates, model presets, project files, slides, livestream recordings, documentation, and any other educational or technical content we make available to Students. • “Student Project” – any project, film, video, script, prompt set, dataset, or other creative work that you develop while enrolled in the School. • “Third‑Party AI Tool” – any software, platform, or model not owned by BeyondEdge (e.g., OpenAI ChatGPT, Sora, Midjourney, Runway, Kling, Suno, ElevenLabs, Magnific etc.) that is referenced, demonstrated, or integrated within the Course Materials. • “License” – the limited, personal, non‑exclusive, non‑transferable, and revocable right to access and use the Service that we grant you under Section 6.
3. SERVICES WE PROVIDE
3.1 Scope. The School offers (a) self‑paced and instructor‑led online courses and masterclasses; (b) live workshops, office hours, critique sessions, and community discussions; (c) downloadable resources such as prompt libraries, LUTs, sound packs, and production templates; (d) mentorship and portfolio reviews; and (e) other educational and advisory products related to AI‑assisted storytelling, pre‑production, production, and post‑production workflows (collectively, the “Services”).
3.2 No Regulated Advice. The Services are strictly educational. BeyondEdge does not provide legal, medical, financial, investment, or professional licensing advice, nor do we guarantee employment, distribution deals, or box‑office results. You remain solely responsible for your creative choices, business decisions, and compliance with union, guild, and local‑film‑commission rules.
3.3 Third‑Party AI Tools. Certain lessons demonstrate or rely on Third‑Party AI Tools. You are responsible for maintaining your own accounts, licenses, usage quotas, and any associated costs for these tools, and for complying with the third party’s terms of service and content policies.
4. ACCOUNT REGISTRATION & ELIGIBILITY You must be (i) at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) and (ii) otherwise legally competent to form a binding contract. If you are under 18, you represent that you have obtained consent from a parent or legal guardian. You agree to provide accurate information and to keep your credentials confidential. You are responsible for all activity under your account.
5. PURCHASES & PAYMENT
5.1 Pricing & Taxes. All prices are as listed at checkout and may vary by region, currency, or promotion. Unless stated otherwise, prices are exclusive of applicable sales, VAT, GST, or other taxes. You authorize us or our payment processor to charge your selected payment method for the total price.
5.2 License, Not Sale. When you purchase a course or subscription you acquire a License to the Course Materials; ownership of those materials and all intellectual‑property rights remain with BeyondEdge and its licensors.
5.3 Refunds. Unless a longer period is required by law, you may request a full refund within seven (7) days of purchase. Access to refunded courses will be terminated once the refund is issued. Marketplace purchases are subject to the marketplace operator’s policies.
6. LICENSE & PERMITTED USES
6.1 Grant. BeyondEdge grants you a limited License to (a) stream or download Course Materials for your own learning, and (b) create Student Projects for personal or professional use.
6.2 Student Projects. You own the copyright in any original expression contained in your Student Projects, subject to any third‑party rights they incorporate. You grant BeyondEdge a worldwide, perpetual, royalty‑free license to display samples of your Student Projects (including your name, likeness, and biographical information) for the limited purpose of promoting the School, unless you opt out via written notice.
6.3 Restrictions. Except as expressly permitted, you shall NOT: • share, resell, publish, or sublicense Course Materials or your login credentials; • use Course Materials to train, fine‑tune, or validate any machine‑learning or generative‑AI model, except for Student Projects derived from your own original contributions; • circumvent digital rights‑management or usage‑tracking tools we deploy; • engage in any activity that competes with the Services or assists others in doing so; • remove copyright notices or branding from Course Materials.
7. COMMUNITY CONDUCT
You agree to abide by our Community Guidelines (available on the Site), which prohibit harassment, hate speech, spamming, and posting infringing or abusive content. We may suspend or terminate your account for violations.
8. INTELLECTUAL‑PROPERTY CLAIMS
BeyondEdge respects intellectual‑property rights and responds to valid DMCA notices. If you believe content on the Service infringes your copyright, please send a detailed notice to [email protected] following 17 U.S.C. §512(c)(3).
9. DISCLAIMERS & LIMITATION OF LIABILITY THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” BEYONDEDGE MAKES NO GUARANTEE THAT COMPLETING A COURSE WILL RESULT IN EMPLOYMENT, FESTIVAL SELECTION, FUNDING, OR ANY SPECIFIC ECONOMIC OUTCOME. TO THE FULLEST EXTENT PERMITTED BY LAW, BEYONDEDGE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES—INCLUDING LOST PROFITS—ARISING FROM OR RELATING TO THE SERVICES.
10. INDEMNIFICATION You agree to defend and indemnify BeyondEdge from any claim arising out of (a) your Student Projects, (b) your violation of the Agreement, or (c) your use of Third‑Party AI Tools.
11. TERMINATION We may suspend or terminate your account at any time, with or without notice, for breach of the Agreement or if required by law. Sections intended to survive (e.g., IP, indemnity, limitation of liability) shall remain in force.
12. GOVERNING LAW & VENUE The Agreement is governed by the laws of the State of Delaware, USA, without regard to conflict‑of‑law principles. Any dispute shall be brought exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to personal jurisdiction and venue in those courts.
13. CHANGES TO THE TERMS We may update these Terms by posting a revised version with a new “Last updated” date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
